First IRS Legal Department, Houston, Texas

Have you been contacted by this group of payday loan collectors?

They claim to be attorneys, not a collection agency.

They ARE debt collectors as defined by federal law.

Here is whom you are dealing with:

These people called me at work and basically made it seem like they were lawyers. I sent them a letter certified and receipt requested telling them to put whatever they have been saying to me in writing. I hope that this would help. I even went so far as to look for a lawyer to represent me...I hope I did the correct thing by sending the letter. I received a voicemail with the person from this place saying I gave you to 5pm and I didn't hear from you so I have nothing but to proceed...This person called my work number at 7pm and left that message. Has anyone out there dealt with these people? Thanks

You should have also told them not to ever call you at work again and to only communicate with you in writing. You may fax them such a letter and it will be effective as long as you print out the fax log showing when they received the fax.

First irs left me a message today Aug. 31, 2010. They told my friend that it is very important that I got hold of them. So I called them back and some man got on the phone and I ask them who they were and where they are from or who the are representing. He went on telling me that he represent an online payday loan and I supposedly gave them a bank account that don't exist. I have until Friday at 4 PM to come up with certain amount of money. If I don't come up with it He told me they would contact Polk County and they would press criminal charges. I explained myself and told him I didn't give him a fake account if they were able to deposit money obviously at one point in time the bank account existed. I also told them that I live on an unemployment check of $99 a week and if he wanted me to make a payment arrangement I would be happy to pay it. I told him I would pay $100 a month he said no and I need to come up with $160 by Friday. He even told me to hustle ad I told him that I don't do such a thing and he responded by telling me he even know how to hustle. I'm very scared and don't have the money to come up by Friday Please I need help!!!!

Take a deep breath. Now one more. They are trying to scare you but don't fall for it. Do you even think this is a valid debt?

These folks are Baaaaaad News:

Don't give them any information. If they call again, firmly state that they must send written validation before you will even consider the matter. They usually try everything in the book to evade validation, including being very abusive. All of these actions indicate they are not legitimate. Most posters on other sites say they do nothing but repeatedly call but never ever put anything in writing.

Google "1st IRS" and you will find several reports--hundreds!-- about their awful practices.

  • If they will not clearly identify themselves
  • If they will not clearly identify the original creditor
  • If they will not provide an address for correspondence
  • If they do not provide written validation within 5 days of calling you



...be very suspicious.


Unfortunately: All indications are that they do not and will not comply with validation or cease & desist requests, oral or written. Nor does anyone end up getting arrested or whatever dire things they say they'll do. Every indication is that they're questionable at best, or extortionists with no valid claims at worst.

More unfortunately:These tactics are very similar to those of an overseas extortion ring that has lists from now-defunct payday loan companies. They call people on the list--no real debts involved--and try to scare them into sending money for unspecified debts. They pose as detectives and Special agents, say they are from the FBI, that it is a criminal matter, etc. All of these tactics violate FDCPA as well as several federal and local criminal laws. Claiming to be a law enforcement officer or representing law enforcement or a federal agency (when you aren't) is criminally prosecutable in most places.

I called First Irs again @ 713-777-2500 Ext 103. I told them who I was and I wanted to know who the original creditor is and before I could say anything else he told me I needed to call him back because he is busy with another client. I researched the original creditor and their website states that it is their policy not extend their services for my state. I know that I did borrow money from them and I'm willing to pay for it but I don't feel they need to threaten me of jail time. But now that I researched it and found out what i found out I don't feel I need to pay for that loan. I don't think that agreement is legal and binding. Do you think I should pay for it or fight it?
