Capital One 1099 1099's

Capital One sued my husband and finally dismissed lawsuit in 2008 because of no validation. SOL in state has been reached in 2008. Yesterday both my husband and I received 1099's on this debt. Him one half and me one half. If they can't validate the debt, is there is any recourse for me? This debt was written off in 2005. Lawsuit dropped in 2008 and just now getting 1099's. I do not meet the 4 criteria shown by IRS but don't understand how they can send 1099 on debt that has not been validated.

Others may have better advice but all I can suggest is talking to a tax professional who's familiar with dealing with these 1099's.

Was this suite dismissed with prejudice?
