this company has been calling me non-stop, and they will not allow me to mail in a payment they are telling me they are going to sue me and they are collecting information for sallie mae and the only way it can be stopped is if I secure it with a debit, credit or check payment AND pay 1500 down on a deposit and set up automatic withdrawals for the remainder. Is this legal?

Send them a certified letter instead. Go to http://uslegal.com/debt-credit/ & see some of the letters to use. Send them a detailed letter called Cease & Desist. If you owe the debt send them in a payment with the letter. If you don't owe it, or you are disputing a charge or the balance send them a letter and demand Verification of Debt with all documentation.
If this company calls you a lot, let them. Have a tape recorder and tape every conversation. If they threaten you, cuss you out, be nice & record it. Then, sue them with the tape as proof. WHY? Becasue there are Federal Laws that protect the consumers they don't want you to know about.Do not pay them until they have proven the debt, and you have everything in writing. Otherwise if you pay them, they make the $$$$ and do nothing for you. It could end up on your credit report as not paid & if this happens, it is hard to prove and get results with no paper trail. So, protect yourself with letters & recordings of phone conversations.
MOST debt collectors say one thing & do something else or nothing; however, some are honest. So, to protect yourself, have it on tape or in writing or both. This way, if you go to court, you have proof & will win the lawsuit. I know this works because I've done it several times & won 5 cases as Pro Se & on the 6th case, I paid 1/2 of the total I owed, the other half was their charges and all & I tried to settle it at 50% before being sued, but they said no. Yet, 1 week before trial, it was agreed to. So you can win.

These sharks are the worst! They are a collection agency who get account from sallie mae, etc. Once they get your account, they are the ones calling the shots, not sallie mae!
We had agreed to make small payments for a couple of months until I could get extra hours at my job. I was about to give them my check account number when a supervisor got on the phone and told me that the deal was off because he noticed that we had an open line of credit with a credit card (that is charging 30%, that is why we got rid of it in the first place). He told me tha If I did not put 2000 dollars with this credit card towards the 11000 dollar loan, he will go ahead and garnish my wages!!!
This is outrageous...he is forcing me to get into more debt at a higher intrest rate in order to pay part of what i owe them!!!
The worst thing is that since this is a student loan, there is nothing I can do about it!!!
Congress should look into this ASAP! This crooks are leagal and are worst than loan sharks!
We bail out multi billionaire institutions, yet we cannot bail out student loan recepients who could prove that they have honestly been trying to do what is right, but have had a couple of bumps in the way!
My situation is not that of a person who does NOT want to pay..,.I want to pay, but cannot afford the amount they want me to pay! I make a little less than my expenses every month!
I am sure that at least 99.9% of the people that get into a student loan, do so with the thought and dreams that once they finish school, they will be able to pay with no problems! How far from the truth!
Hmm, maybe if you get into organized crime! That might be the only way to get out of this wind tunnel!
All I can say is, hang in there. Write to your congressman about your situation, write to your senators, write to all who would listen!
In this great country of ours, only two kinds of people survive...the rich, because they have the means...and the poor, because they get all kinds of financial help (welfare, housing, food, medical, etc)...HOWEVER, the so called working CLASS cannot survive!
I dont qualify for ANY kind of public assistance, I have to pay taxes just like everyone else, yet I dont qualify to receive any temporary help for the very services that my taxes are collected for!!!
