Finkelstein, Kern, Steinberg, & Cunningham- The 2nd largest collection-law firm in Tennessee. They will soon surpass the largest and by August the law firm will have expanded into KY, AR, MS, GA They have lawyers taking the bar exam right now in AR. KY is there first move because it is a "non-appearance" state. Meaning They will file lawsuits and do not have to have an attorney appear in court to obtain a default judgment. If someone files a sworn denial or challenges, they will fight it from TN.
Most collectors threaten legal actions such as arrest, wage garnishments, seizure of assets and notification of employers and third parties about debts. The most atrocious practice is the collector reaches some "pay agreement" with the debtor. The debtor assumes things are ok and the collector informs the debtor since they have reached an agreement the debtor can ignore the civil court date. THEN the attorney enters a default judgment and the garnishment department begins adverse proceedings. Collectors are instructed to never let the debtor speak to an attorney- all call are referred to paralegals. The only time a debtor sees the attorney is in court.
Third: When a debtor requests validation, the clients delay up to 120 days to provide the information, but the firm issues civil summons and continues to try an force a court appearence. Most of the time the validation is never received. . The firm was reprimanded by a Judge in Shelby County TN for its unetheical and illegal practices.

folks, review THE TENNESSEE FAIR DEBT COLLECTION PRACTICES ACT !
You will find that the law specifically states that "no one can COMMENCE or CONDUCT COLLECTION BUSINESS in this state, unless that person(or company) has a license to collect Debts in the State of Tennessee. You will also find Tennessee does not have 'reciprocal agreements" with other states !

HI,
I tried to register but the forum says its not taking new registrations so I hope someone sees this.
My husband and I both just received letters in the mail from Finkelstein, Kern, Steinberg and Cunningham saying that they are filing a motion for renewal or revival of judgment. The letters were both sent through regular mail .. not certified mail or delivered in person as required by TN for service of process.
It is claiming that there is a judgment against us from Bureaus Investment Group, LLC from April 2, 2002 from Sumner County General Sessions Court.
Both letters are identical except one is addressed to my husband and one to me..
The date at the top of the letter is October 10 , 2011... yet everything that is hand dated and signed is dated jan 5, 2012..
It also says on page 3:
" Comes the Plaintiff, by and through counsel , and gives notice to the Defendant(s) ( our names ) , that the Plaintiff shall proceed to hear its Motion for Reneal of Judgment on Feb, 7, 2011 ( yes, it says 2011 ) at 1:P<. before the Sumner County General Sessions Court , Gallatin , TN 37066.

Also at the bottom of that page , it says
certificate of service
I certify that a true and correct copy of the attached document has been either hand-delivered or properly mailed, by placing same in the United States Mail, postage prepaid, to the following
and again signed and dated by ron .
Any ideas on how to proceed would be appreciated... This is the first we are hearing about this judgment in 2002.
Also, if TN says that a summons must be handed in person or certified mail, can they just throw a regular letter in the mail and say they complied?
