I have been sued by Ability Recovery Services. I was served papers from the Sheriff's office and I had a certain amount of days to decide what I was going to do. I filed a paper with the court listing the violations that Ability Recovery Service made against me, such as not responding to my certified letter asking them to verify that I really did owe this money. (I listed more violations than this one!!) I then received a letter from the court that my hearing will be in a few weeks. I would like any other information any of you may have that I can take to court with me. Also, if any of you would like the info I have, please let me know.
Make sure you appear for the hearing and if they get a judgement against you appeal it immediately. The court clerk will have the appeal forms. Appeals take over 6 months and then it usually goes into arbitration where a panel of attorneys decide the case and the court may require ARS to post a bond up to $1500.00 just in case they lose like the losers they are.
